Facts of the case:
There was an agreement between plaintiff and defendant for the transaction of land ( area 5-5-2-3 of kitta no.68 and of area 8-1-3-0 of kitta no. 69). On 2057/09/16 defendant agreed to sell the land for 1,25,000/- and took 75,000/- as advance by sighing the document. Dispute arises when defendant refused to register the land in the name of plaintiff. Regarding the breach of the agreement Lakh Bahadur Mabo filed a case in Panchthar District Court. Unsatisfied with the decision of District court plaintiff goes to Ilam appellant court. Unsatisfied with the decision of Illam appellant court, defendant goes to supreme to file a case against plaintiff.
Plaintiff’s Claim:
Plaintiff was obliged to pay the remaining balance of NPR 50,000/- by 2057/09/30, and defendant would execute the deed and transfer the land registration. plaintiff claimed that when he went to pay the remaining amount within the deadline, defendant refused to accept the money and transfer the land, intending to sell it elsewhere. Therefore, plaintiff requested the court to enforce the breach clause of the contract and make defendant pay double the earnest money amount, totaling NPR 1,50,000/-, plus court fees.
Defendant’s arguments:
Defendant admitted to entering into the agreement on 2057/09/16 and receiving the NPR 75,000/- earnest money. However, defendant argued that plaintiff failed to bring the remaining balance of NPR 50,000/- within the strict contractual deadline (by 2057/09/30). Because plaintiff breached the deadline, the land could not be transferred. The defendant further argued that plaintiff did not approach a legally authorized body (court) but instead filed a petition at the Village Development Committee (VDC) office after the deadline had already expired.

Decisions of Courts:
Panchthar District Court: Dismissed the plaintiff’s claim. Court ruled that if defendant had refused to accept the remaining money, the plaintiff should have deposited the balance in court and demanded the land transfer. Since plaintiff did not deposit the money and failed to prove he followed the contract rules, he cannot claim double the money.
Illam Appellate Court: Reversed the District Court’s decision and ruled in favor of plaintiff. The court noted that the contract was undisputed. Since, plaintiff had filed a petition at the VDC office, it showed he made an effort to pay the money. Therefore, defendant breached the contract and must pay double the earnest money (NPR 1,50,000/-).
Supreme Court: Reversed Appellate Court’s decision and upheld District Court’s decision. The plaintiff’s claim for double the money was rejected.
